Suspended Guyton Councilman Resigns Ahead of Court Date

Suspended Guyton City Councilman Theodore Hamby has resigned from his post almost a year after his arrest by the Georgia Bureau of Investigation.

Hamby was suspended by Governor Brian Kemp last year following his indictment on felony charges related to his use of the city credit card. The Georgia Bureau of Investigation was called into investigate after city officials noticed discrepancies after Hamby’s use of the card and he was arrested not long after on charges of Theft by Taking and Financial Transaction Card Fraud.

Mayor Andy Harville asked Hamby to resign from his post, but he refused. Hamby was later indicted on a host of charges, including Financial Transaction Card Fraud (x3), and Making False Statements (x2). Another indictment added Violation of Oath of Office to his list of charges.

Wednesday’s resignation comes ahead of his scheduled plea date in Effingham County Superior Court slated for next week.

According to city officials, under the City Charter, when a vacancy occurs with 14 months or more remaining in the unexpired term, the position must be filled by a special election pursuant to Section 5.14.
