Approval of Zoning Agenda
Gregory Trapnell Sikes has submitted a request for a conditional use to locate a 195-foot tower to be used for communications equipment. The property is located on Pless Clifton Road.
The subject property abuts adjacent AG-5 zoned properties. This property has historically been used for agricultural use, and is intended to use 0.232 acres of the property for the communications tower. There are currently no structures on the property.
A third-party reviewer analyzed this request to determine compliance with the governing standards for the exercise of zoning and subdivision powers within Bulloch County. Staff recommended approval of the conditional use request with conditions. P&Z recommended approval as well.
Commissioner Toby Conner recused himself from discussion and voting because of his financial interests in the property. Motion from Rushing, seconded by Mosley, and approved 4-0.
Janet Lanier has submitted an application to rezone approximately 10.55 acres from R-80 (Residential 80,000 sq. ft.) to R-2 (Multiple Family Residential 15,000 sq. ft.) for the purpose of creating a two-family (duplex) housing development. The property is located at 424 Brannen Drive.
This zoning request was withdrawn without prejudice.
Bulloch County has submitted a text amendment application requesting to modify text within the Bulloch County Code of Ordinance Appendix C to include modifications to 202 Definitions, 802 Commercial and Industrial Principle Uses to include Microbrewery and Brewpub, 1404 Accessory Dwellings, 1414 Church or Place of Worship, 1426 Home Occupation- Residential, 1439 Planned Residential Developments with single-family and for two-family dwellings, including mixed-use residential developments, 1453 Racetrack & ATV Trail Riding Clubs, 1454 Microbrewery and Brewpub, and Article 11 Conservation Subdivisions.
Appendix C of the Bulloch County Code of Ordinance was last updated in December of 2024. Bulloch
County staff initiated this request for a text amendment to Appendix C. After hearing the presentation of
the request, the planning commission voted unanimously (6-0) to recommend approval of the text
amendment request
Planning Director James Pope presented to commissioners a summary of the proposed changes:
- Previously no definition for townhouse except in PUD zoning.
- GoCart/ATV and Motorbike track and trails – Pope said they are still working to narrow the scope. The attempt is to address commercial practices when money is exchanged. Individual landowner activity is exempt under the proposal.
- Microbrewery/Brewpub/Large brewery – these are not currently defined in Bulloch’s ordinance
- Supplemental standard for GoCart/ATV and Motorbike track and trails
- 11 items that would apply to any track or trail in a commercial operation
- Applies to more than 100 acres
- Prohibits dust from leaving property
- No fording of creeks
- Hours of operation shall be limited to the following:
- Sunday thru Thursday no earlier than 7:00 a.m. and no later than one hour after the sunsets.
- Friday and Saturday no earlier than 7:00 a.m. and no later than 10:00 p.m.
- All ATV and motorcycles operating on the trails will be limited to a maximum decibel level of
120db at operating speeds. Tested no more than five feet from the vehicle. - All ATV and motorcycles operating on the trails will be required to have spark arrestors.
- The entirety of the property must be fully fenced.
- “Quiet zones” to limit loud music and noise other than that produced by the vehicles shall be
enforced within 500 feet of property lines in trail areas that are adjacent to residential properties.
Quiet zones shall be clearly marked with signage visible to patrons. - Access to public streets shall require permit approval by the County Engineer or designee.
- No trail shall be located within 50 feet of the property boundaries.
- Where trails are proposed to disturb wetlands, Chapter 4, Section 4-50.1 of the Bulloch County Code of Ordinances and requirements of the Federal Clean Water Act, as amended, are required. Generally, a wetland determination by the U.S. Army Corps of Engineers must be provided prior to site plan or other permit approval.
- Uses of accessories to churches – parsonage is not currently considered part of the church in the ordinance
- Accessory Dwellings generally – currently only allowed in planned residential subdivision, not in other zonings like AG-5. This amends that.
- Also keeps accessory buildings from exceeding 60% of the size of the main dwelling.
- Home Occupation, residential – Type of delivery trucks that can go to home occupations in an effort to limit damage to infrastructure
- Anti-Monotony Facades – Prohibits mirror images or repetition of the same configuration of each dwelling. Prohibits same elevation design within two houses on each side or directly across the stree
- Front Facade Limitations – Requires things like 8 feet wide and 6 feet depth supported by columns with a rail
- Separate overhead door for each single garage bay
- Brick, stone, or textured concrete masonry on 100% of the front elevation (excluding openings)
- Addresses Wall Finishes –
- Addresses Street Lighting –
- Foundation Walls – exposed foundation walls must be faced in brick, stone, or manufactured stone to the level of the first finish
- Windows – Windows on each side must be 5% of the area
- Conservation Subdivisions –
Justin Strickland spoke on behalf of Savage Trails, saying it operated without any major safety issues and said it has had an economic impact on the county as a whole. He asked for Savage Trails to be grandfathered in to the old zoning ordinances, irrespective of how the ordinance is changed in the future.
No one else spoke in favor or against the proposed changes.
Chairman David Bennett asked if the ATV provision would apply to private landowners on their own property. Pope replied that it would not.
Commissioner Nick Newkirk asked if the ordinance would apply to new businesses only or if it would be retroactive. Jeff Akins asked if he was referring to Savage Trails, which Newkirk answered affirmatively. The county’s position, according to county attorney Jeff Akins, said they were never a legitimate business because they never obtained a conditional use permit.
Commissioner Toby Conner made a motion to table the agenda item until the next evening county commission meeting – November 4, 2025.
Approval of General Agenda
Public Comments
Public Works Director Dink Butler – Butler said he and two others were affected by the GBI investigation. He asked Chairman David Bennett to read the letter from the Prosecuting Attorneys Council (PAC) into the record. Bennett then read a press release from the county regarding the closed investigation from August 22, 2025. Butler then thanked the commissioners from
Commissioner Timmy Rushing then apologized to the county employees and the contractors who were impacted by the GBI investigation.
Chairman Bennett said he hoped everyone could put this behind them now, move forward, and quit living in the past.
Alexis Waters – Spoke in favor of Savage Trails and implored the county to allow it to operate.
Megan Snellgrove – Spoke in favor of Savage Trails and said it has become like family. She asked for Savage Trails to be grandfathered in.
Consent Agenda
With the exception of #3 on the agenda, the consent agenda was approved unanimously in a single vote. #3 was moved to New Business.

Motion to Approve the Purchase of Breathing Air Compressor from B&T Enterprises LLC – This item was moved to the New Business portion.
Currently, there are only three compressors around the county to fill SCBA cylinders after fires and training events. These air compressors are a vital part of our operations, this purchase will allow the firefighters to fill SCBA cylinders at their station and help reduce out of service time for our unites.
Motion to Purchase the Bullard Thermal Imaging Cameras
The Bulloch County Fire Department seeks to purchase 4 new Bullard Thermal Imaging Cameras, This purchase will help our Department equip our new engine’s with life saving equipment to better serve our citizens. Bullard cameras have become the camera or choice for Bulloch County; Thermal Imager’s allow Firefighters to see through smoke to locate fire, exits, and victims.
Motion to Purchase Hurst Rescue Tools from MES
The Bulloch County Fire Department was budgeted $110,000 to purchase Hurst eDraulic rescue tools, the purchase price is $99,509.42 for two sets. Each set will include; a cutter, spreaders, ram, batteries, chargers, as well as air bags, controls and struts. This purchase will help our Department equip the two new engine with life saving rescue tools to better serve our citezens.
Motion to Approve Long Leaf Pine Straw contract renewal from Brian T. Powell Enterprises Inc.
Bulloch County Recreation and Parks Department bids out pine straw to lock in a price for a 12-month period from one vendor. The Parks Division generally uses 2850 bales for our parks, 1800 bales for county-maintained buildings under county landscape contract, and 1850 bales for the 301/16 area for a total of 6500 bales. 4650 bales would come out of parks and grounds budget and 1850 bales for 301/I16 would come out of the transportation department budget.
Brian T. Powell Enterprises was awarded the bid in FY25, with the option to renew under the same terms and conditions for two consecutive years. The current contract runs from November 7, 2024 to November 6, 2025. Powell has agreed to supply us with pine straw for the same price for another year, which would be the first renewal.
It is the recommendation of Cannon Petitjean, Parks Division Manager, to renew the contract with Brian T. Powell Enterprises for $23,270.00, which equates to $3.58/bale. The renewal contract would begin November 7, 2025 to November 6, 2026.
Approve a Resolution Authorizing Acceptance of Roads in Hamilton Landing Subdivision Information
The developer has requested that the County accept dedication of and title to the roads in Hamilton Landing Subdivision. As indicated by the attached memo from Interim County Engineer Ron Nelson, the County Engineering Office inspected these roads and determined that they comply with all County requirements. Approval of the attached resolution will implement acceptance of these roads and authorize Chairman Bennett to accept a deed for these roads on behalf of the County.
Approve a Resolution to Establish Streetlight District for Phase 6 of River Bluff Subdivision
The developer of River Bluff Subdivision has submitted an application to establish a streetlight district for Phase 6 of the subdivision. As required by the streetlight district ordinance for new developments, the Planning & Zoning Commission heard the application and has recommended approval. Adoption of the presented resolution will establish a streetlight district for Phase 6 of River Bluff Subdivision. Approval is recommended.
Approve a Resolution to Establish a Special Streetlight District for Phase 2 of Rexford Subdiivision
The developer of Rexford Subdivision has submitted an application to establish a streetlight district for Phase 2 of the subdivision. As required by the streetlight district ordinance for new developments, the Planning & Zoning Commission heard the application and has recommended approval. Adoption of the presented resolution will establish a streetlight district for Phase 2 of Rexford Subdivision. Approval is recommended.
Approve a Resolution to Establish a Special Streetlight District for Arcadia at Lotts Creek Subdivision
The developers of Arcadia at Lotts Creek Subdivision have requested the creation of a special streetlight district for this subdivision. As required by the streetlight district ordinance for new developments, the Planning & Zoning Commission heard the application and has recommended approval. Adoption of the presented resolution will establish a streetlight district for Arcadia at Lotts Creek Subdivision. Approval is recommended.
Motion to approve a purchase order in the amount of $58,696.06 for HVAC systems for the new office building for the Crime Suppression Division of the Sheriff’s Office on Randy Lowery Road.
Four quotes have been obtained for the HVAC systems. This is to include all labor and materials. This is for the new office building for the Crime Suppression Division of the Sheriff’s Office. It is to replace the old building that was torn down. JD Heating and Air submitted the low quote of $58,696.06 for this service. Approval is recommended.
New Business
Motion to Approve the Purchase of Breathing Air Compressor from B&T Enterprises LLC
This item was from the Consent Agenda #3.
Approved unanimously after clarification that the compressors were being added to the current fleet of compressors.
Authorize the County Manager to Execute a Contract for Consulting Services for an Impact Fee Program with Hatley Plans LLC in the Amount of $85,760. Services will Include: Preparation of an Impact Fee Methodology Report, Capital Improvements Element, Final Impact Fee Schedule and Ordinance for Commission Approval, Assistance with Program Implementation, etc. (Approx. 10 Months)
Recommend approval to award a contract with Hatley Plans, LLC. for consulting services in conjunction with an Impact Fee Program in the amount of $85,760.
In 1990, the Georgia Development Impact Fee Act (DIFA) was enacted into law, and it significantly impacted the way local governments in Georgia are able to pay for public services and facilities. Impact fees are one-time fees charged to certain building permittees to help defray the costs of expanding capital facilities to serve new growth. DIFA enables local governments to charge new development for a proportionate share of infrastructure capacity it requires. However, the Act places restrictions on the categories of capital facilities for which new development can be charged. It also establishes rules under which impact fees must be calculated, collected, expended, accounted for, and administered.
To ensure compliance with DIFA, a contract for services provided by Hatley Plans, LLC is recommended.  Paige Hatley, President of Hatley Plans, LLC has prepared development impact analysis and fee systems for a wide range of cities and counties. Her experience in Georgia has included assistance in the preparation of impact fee studies and implemented programs in more than 25 Georgia cities and counties, and involvement with the Impact Fee Advisory Committees for all new impact fee programs.  Clients include small cities, large metropolitan jurisdictions, fast growing jurisdictions and small rural counties. 
Hatley Plans, LLC. services will include advice and assistance to the County in general on impact fee matters, the preparation of an Impact Fee Methodology Report (including all impact fee calculations), preparation of a Capital Improvements Element (CIE), the preparation of a final impact fee schedule for adoption, preparation of an Impact Fee Ordinance conforming to all current state law requirements, and assistance to staff in implementing the program.  As part of this process, specific consideration will be given for the creation and amount of impact fees for the County in these public facility categories: roads, streets, and bridges, including rights of way, traffic signals, landscaping, and any local components of state or federal highways; parks, open space, and recreation areas and related facilities; library services; and public safety facilities inclusive of multiple sub-categories. 
The services provided by Hatley Plans, LLC. will result in the completion of an impact fee program and fee schedule for Bulloch County meeting all legal and administrative requirements. In addition, the CIE will conform to Georgia Department of Community Affairs requirements for inclusion in the County’s 2045 Comprehensive Plan.  It is anticipated that the process of establishing an impact fee program will take ten months. 
The Bulloch County purchasing policy was followed to procure the contract for consultant services. The Request for Proposal advertisement was issued August 11, 2025, using the following methods: Three (3) RFPs were emailed; an ad was placed on the County website along with being posted on GA Procurement Registry August 11, 2025. A question and response period was provided between August 20th at 11:00am to August 22nd 11:00am.
The County received four (4) responses by the 3:00PM September 10, 2025 deadline. Of the four submittals, three (3) were found responsive following an administrative review. The members of the review team ranked each firm individually and the results were tallied. Hatley Plans, LLC. was the highest ranking firm with the scale advertised in the Request for Proposals.
The vendor is: Hatley Plans, LLC. (3175 Madison Ave. NE, Brookhaven, GA 30319)     $160.00 an hour not to exceed   $85,760.

Approve an Intergovernmental Agreement with Brooklet for the Renovation and Improvement of Recreation Facilities
Pursuant to the Service Delivery Agreement, Bulloch County provides recreation services county wide, including within the municipalities in the County. However, the City of Brooklet included $290,000 in its 2019 SPLOST allocation for recreational facilities and/or equipment in order to provide a higher level of service to its citizens. The presented intergovernmental agreement facilitates renovations and improvements to the Brooklet recreation facilities using Brooklet’s SPLOST funds. Pursuant to the agreement, Brooklet will transfer its $290,000 in recreation SPLOST funds to the County The County will then undertake the renovations and improvements set forth in the agreement. If the cost of the renovations and improvements is less than $290,000, the County will refund the balance to Brooklet for reallocation to other Brooklet SPLOST projects. If the cost is more than $290,000, the County will use a portion of its recreation SPLOST funds to pay the balance. The agreement also provides that Brooklet agrees to allow the County to continue using its property for recreation purposes for 50 years, and the County is likewise obligated to continue using the property for recreation purposes for 50 years, unless the agreement is otherwise modified. Brooklet approved the agreement at its meeting on September 18th. Approval is recommended.

Motion to Approve a Contract with Reeves Construction Company in the amount of $3,125,604.89 to administer performance of the work associated with FY26-CP-E05 Bulloch County Road Resurfacing Project. The cost for this work will be funded using a combination of LMIG and TSPLOST funds.
The Bulloch County Engineering Office, in cooperation with the Bulloch County Procurement Manager, prepared a Notice of Solicitation, Invitation to Bid for FY26-CP-E05 Bulloch County Road Resurfacing. This Invitation to Bid (ITB) solicited sealed bids from GDOT prequalified contractors for paved road resurfacing work that includes asphalt resurfacing, earth shoulder building, paved shoulder building, and roadway striping for approximately 15.14 miles along County paved roads. Additionally, this ITB included one (1) Add Alternate Item that included approximately 1.47 miles of asphalt resurfacing, earth shoulder building, and roadway striping along Brooklet Denmark Road beginning at the west end of the Lower Black Creek Bridge and ending at the asphalt pavement joint approximately 570 feet east of the SR67 signalized intersection. Reeves Construction Company was determined to be the low bidder with a total bid of $3,125,604.89 while also satisfying the ITB’s Terms and Conditions of Procurement for award by having a current GDOT Prequalified Contractor certificate as determined by reviewing the GDOT webpage. The Bulloch County Engineering Office recommends acceptance of the low bid from Reeves Construction Company in the amount of $3,125,604.89 to administer performance of the work associated with FY26-CP-E05 Bulloch County Road Resurfacing Project. The cost for this work will be funded using a combination of LMIG and TSPLOST funds.

The Bulloch County Engineering Office, in cooperation with the Bulloch County Procurement Manager, prepared a Notice of Solicitation, Invitation to Bid for FY26-CP-E06 Register Fire Station #3 New Paved Driveways & New Paved Parking Facility. This Invitation to Bid (ITB) solicited sealed bids from GDOT prequalified contractors for demolition of the existing driveways and parking area, while also constructing new paved driveways and a new paved parking facility.

Motion to approve Task Order FY26-ROW-E05 in the amount of $217,275.00 to provide right-of-way acquisition services along Grimshaw Road and Grimshaw Lane which is in conjunction with FY25-CP-E05 Roadway Design Batch 1. This work will be funded by TSPLOST.
The Bulloch County Engineering Office is requesting approval from the Board of Commissioners for Bulloch County to enter into Task Order FY26-ROW-E05 with Johnson, Mirmiran, and Thompson, Incorporated (JMT) for the purpose of right-of-way acquisition on Grimshaw Road and Grimshaw Lane. The active roadway design & engineering project known as FY25-CP-E05 Roadway Design Batch 1 Floyd Clark Road & Others, which is being delivered by Kimley-Horn & Associates, has progressed to allow Bulloch County to begin the right-of-way acquisition phase along Grimshaw Road and Grimshaw Lane. The scope of this work is being requested in accordance with the Master Services Contract for County Road Right-of-Way acquisition services with JMT approved by the Board of Commissioners during the 04/01/2025 regular meeting.
Bulloch County contracted with Kimley-Horn & Associates 01/29/2025 to design and engineer paving and drainage improvements along Grimshaw Road beginning at Alderman Road and extending to US80 near MP 23.9. Kimley-Horn & Associates has progressed the project design to an acceptable level of detail allowing the right-of-way acquisition phase to begin. The Bulloch County Engineering Office requested a fee proposal from JMT for right-of-way acquisition services along Grimshaw Road and Grimshaw Lane. JMT submitted Task Order FY26-ROW-E05 on September 3, 2025, for $217,275.00 to provide right-of-way acquisition services affecting forty-six (46) parcels along Grimshaw Road and Grimshaw Lane. The Bulloch County Engineering Office recommends approval of JMT’s proposed Task Order FY26-ROW-E05 for $217,275.00 to provide right-of-way acquisition services along Grimshaw Road and Grimshaw Lane. The cost for this work will be funded by TSPLOST.

The active roadway design & engineering project known as FY25-CP-E05 Roadway Design Batch 1 Floyd Clark Road & Others, which is being delivered by Kimley-Horn & Associates, has progressed to allow Bulloch County to begin the right-of-way acquisition phase along Prather Road. The scope of this work is being requested in accordance with the Master Services Contract for County Road Right-of-Way acquisition services with JMT approved by the Board of Commissioners during the 04/01/2025 regular meeting.
Bulloch County contracted with Kimley-Horn & Associates 01/29/2025 to design and engineer paving and drainage improvements along Prather Road beginning at the existing end-of-pavement section along Prather Road and extending approximately 4,450 LF (0.84 mi). Kimley-Horn & Associates has progressed the project design to an acceptable level of detail allowing the right-of-way acquisition phase to begin. The Bulloch County Engineering Office requested a fee proposal from JMT for right-of-way acquisition services along Prather Road. JMT submitted Task Order FY26-ROW-E06 on September 3, 2025, for $133,650.00 to provide right-of-way acquisition services affecting twenty-eight (28) parcels along Prather Road. The Bulloch County Engineering Office recommends approval of JMT’s proposed Task Order FY26-ROW-E06 for $133,650.00 to provide right-of-way acquisition services along Prather Road. The cost for this work will be funded by TSPLOST.

Background – The Board of Commissioners approved a Contract with EMC Engineering on 02/15/2023 to provide design & engineering services for FY23-CP-E02 Roadway Design of Moore Road, Lee Road, and J.A. Hart Road with an original not to exceed amount of $95,000.00. Subsequently, the Board of Commissioners approved Change Order #01 10/24/2023 in the amount of $23,365.00 for additional scope involving the preparation of a Nationwide Wetland Permit, as required by the USACE, on FY23-CP-E02 Design of Moore Road, Lee Road, and J.A. Hart Road. The approval of CO#01 increased the not to exceed amount to $118,365.00.
Request – The Bulloch County Engineering Office is requesting approval from the Board of Commissioners for Change Order #2 on FY23-CP-E02 Roadway Design of Moore Road, Lee Road, and J.A. Hart Road in the amount of $18,479.00. Change Order #02 is necessary to account for modifications, requested by the Bulloch County Engineering Office, to previously approved right-of-way plat. The County’s request for modification included adjustments to construction easements, added driveway easements to allow paved driveway access to each road, added end treatments to stormwater pipes, and made adjustments to easements and right-of-way lines. Additionally, all of the aforementioned modifications required updates to the final construction plans. The requested changes will enhance communication with property owners during the right-of-way acquisition phase of project delivery. The Bulloch County Engineering Office recommends approval of Change Order #02 for FY23-CP-E02 Roadway Design of Moore Road, Lee Road, and J.A. Hart Road in the amount of $18,479.00 and increasing the not exceed amount to $136,841.00.
